This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at www.facturee.com (the “Site”) and use our online manufacturing services.

Because FACTUREE is operated by a company established in the European Union, this Privacy Policy addresses both United States state privacy laws(such as the California Consumer Privacy Act as amended by the CPRA) and the EU General Data Protection Regulation (GDPR), which applies to our processing of personal data regardless of where you are located.

  • Order and Manufacturing Data: Technical drawings, CAD models, dimensions, specifications, and other proprietary data you upload to our platform to receive a quote or fulfill an order. See Section 10 for how we protect the confidentiality of this data.
  • Derivative and Technical Data: Information our servers automatically collect when you access the Site, such as your IP address, browser type, operating system, access times, the pages you viewed directly before and after accessing the Site, and your approximate geographic location.
  • Financial Data:Information related to your payment method (e.g., payment card details) collected by us or our third-party payment processors [e.g., Stripe — insert actual processor(s)] when you purchase services. We do not store full payment card numbers on our own systems.

We do not knowingly collect sensitive personal information (as defined under applicable US state laws) and we do not use or disclose personal information for purposes that would require a “Limit the Use of My Sensitive Personal Information” option.

  • Comply with legal obligations, such as commercial and tax record-keeping requirements — legal obligation (Art. 6(1)(c) GDPR).
  • Optimize, secure, and maintain the functionality and stability of our websitelegitimate interests (Art. 6(1)(f) GDPR).
  • Respond to product inquiries, customer service requests, and emailsperformance of a contract or steps prior to entering a contract (Art. 6(1)(b) GDPR).

We use cookies and similar technologies on the Site. Non-essential cookies are set only with your consent, which we obtain through our cookie consent manager Usercentrics) when you first visit the Site. You can update or withdraw your consent at any time via the cookie settings link on the Site.

  • Essential Cookies: Required to operate core functions such as the shopping cart or language selection. These are deleted when you close your browser and do not require consent.

Appeals: If we decline to act on your request, residents of certain states (e.g., Virginia, Colorado, Connecticut, Texas) may appeal our decision by replying to our response or contacting privacy@facturee.de with the subject line “Privacy Appeal.” If your appeal is unsuccessful, you may contact your state Attorney General.

 

7. Your European Privacy Rights (GDPR)

Where the GDPR applies to the processing of your personal data, you have the right to:

  • Access your personal data (Art. 15 GDPR);
  • Rectification of inaccurate data (Art. 16 GDPR);
  • Erasure (“right to be forgotten”) (Art. 17 GDPR);
  • Restriction of processing (Art. 18 GDPR);
  • Data portability (Art. 20 GDPR);
  • Object to processing based on legitimate interests, including profiling, and to object at any time to processing for direct marketing purposes (Art. 21 GDPR);
  • Withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal (Art. 7(3) GDPR).

8. International Data Transfers

We are a German company. Personal data we collect is primarily transferred to, processed, and stored in Germany and other European Union member states, where our servers and corporate offices are located.

Some of our service providers (including Google, Microsoft, LinkedIn, and Cloudflare) may process personal data in the United States or other countries outside the European Economic Area. Where this occurs, we ensure an adequate level of data protection through appropriate safeguards, in particular the EU-U.S. Data Privacy Framework (where the provider is certified) and/or the European Commission’s Standard Contractual Clauses (SCCs), supplemented by additional technical and organizational measures where necessary.

 

9. Data Retention

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. In particular:

  • Order, invoice, and contract data: retained for up to 10 years to comply with German commercial and tax law (Sec. 257 German Commercial Code (HGB), Sec. 147 German Fiscal Code (AO));
  • Quote requests that do not lead to an order: retained for [insert period, e.g., 24 months] after the last contact;
  • Marketing data: retained until you opt out or withdraw consent;
  • Technical log data: retained for [insert period, e.g., 30 days] for security purposes;
  • Cookie data: retained according to the lifespans disclosed in our Usercentrics consent manager.

When personal information is no longer needed, we delete or anonymize it.

 

10. Confidentiality Of Your Technical And Manufacturing Data

We understand that the technical drawings, CAD models, and specifications you upload are commercially sensitive and may contain your intellectual property. We treat this data as confidential:

  • It is used solely to prepare your quote and fulfill your order;
  • It is disclosed only to the manufacturing partners involved in producing your parts, and only under strict confidentiality (non-disclosure) agreements;
  • It is not used for advertising purposes and is not sold or shared with third parties for their own use.

 

11. Security Of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against interception or misuse.

 

12. Children’s Privacy

Our Site and services are directed at businesses and professionals. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us with personal information, please contact us at privacy@facturee.de and we will delete it.

 

13. Marketing Communications

Where we send you marketing emails, you can opt out at any time by clicking the “unsubscribe” link contained in every marketing email or by contacting us at privacy@facturee.de. Transactional emails relating to your quotes and orders are not affected by a marketing opt-out.

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. We will notify you of material changes by updating the “Last Updated” date at the top of this Privacy Policy and, where required by law, by providing additional notice.
